By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.

Reputation Management

The services will be paid for in full at the end of the 14 day free trial using the payment details provided by you upon subscription.

These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide.

You agree to purchase goods and services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid.

You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Third Party Goods and Services

Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

Subscriptions

Your subscription automatically renews and you will be automatically billed until we receive notification that you want to cancel the subscription. You can cancel your subscription at any time by going to to Setting-Billing inside your account.

Refunds will not be granted if you fail to cancel your subscription within the 14 day trial period - your card will be charged at the end of the free trial with the agreed amount shown on the sales page where you signed up.

If for any reason you are unable to locate the billing section to cancel your subscription simply send an email to

[email protected] confirming your name, account name and email address with instruction that you wish to cancel your account. Please note that your account will be cancelled with immediate effect and you will no longer have access to any contacts or anything you may have created or built.

Payments

We accept the following payment methods on our Site:

Credit Card; and

Debit Card

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use.

By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Email Services

Sending emails from within your Automation Hub account incurs an additional cost.

This fee is $0.0008 per email. Which means $10 will give you about 12,500 emails. Email charges are made on a pay as you go basis and the amounts set can be amended by each user within the company billing.

Phone & SMS Services

Sending SMS & making phone calls from within your Automation Hub account incurs an additional cost.

Rates may vary slightly per region - details for your specific region are available request.

Making calls - This fee is approx $0.021 per minute to make calls which means $10 will give you about 475 calls.

Receiving calls - This fee is approx $0.0128 per minute to make calls which means $10 will give you about 780 calls.

Text Messages/SMS - This fee is approx $0.0119 per segment (approx 140 characters) which means $10 will give you about 840 segments.

You can access these services by adding credit to use in the billing section or request to have them switched off by contacting support.

The cancellation period:

Will end 14 days from the date of purchase. To exercise your right to cancel you must inform us of your decision to cancel within the cancellation period.

The right to cancel does not apply to:

Custom or personalised services;

Free trial periods;

Services that the customer has requested for the purpose of carrying out urgent support.

Migration

We reserve the right to refuse the release or migration of your account to another Agency or white labelled High level platform.

The Automation Hub Templates are to be used exclusively on The Automation Hub platform unless expressed otherwise.

Cancellation of your subscription will result in loss of use of all Automation Hub Templates & services.

Effects of Cancellation

If you requested the performance of services begin during the cancellation period, you are required to pay us an amount which is in proportion to what has been performed until you have communicated to us your decision to cancel this contract. If you provide express consent to the supply of digital content during the cancellation period and acknowledge that your right to cancel the contract is lost by the supply of digital content during the cancellation period, you will no longer have a right to cancel the contract.

We will make the reimbursement using the same form of payment as you used for the initial purchase unless you have expressly agreed otherwise. You will not incur any fees because of the reimbursement.

This right to cancel and to reimbursement is not affected by any return or refund policy we may have.

Refunds for Services

We provide refunds for services sold on our Site as follows:

Customers will be fully refunded if they cancel their subscription within 14 days of creating a new user account.

Consumer Protection Law

Where the Sale of Goods Act 1979, the Consumer Rights Act 2015, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation.

These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Our Site contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.

The Digital Success Group, The Automation Hub and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless The Digital Success Group Ltd. The Automation Hub and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the Country of England.

Dispute Resolution

Subject to any exceptions specified in these Terms and Conditions, if you and The Digital Success Group/The Automation Hub are unable to resolve any dispute through informal discussion, then you and The Digital Success Group agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and The Digital Success Group.

Notwithstanding any other provision in these Terms and Conditions, you and The Digital Success Group agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

Users are expected to interact responsibly with the AI models. Any attempt to make the AI generate hateful, illegal, or offensive content is strictly against these terms and conditions.

Intellectual property

Understanding the ownership of content generated through our platform is crucial for all parties involved.

Ownership of generations

The intellectual property rights of the responses or content generated by the AI models on this platform belong to The Digital Success Group & The Automation Hub. As such, you are not permitted to reproduce, distribute, or claim ownership over these generated responses as your own work. This includes passing off AI-generated content as if it were produced by you.

Liability and disclaimers

This section outlines the limitations of liability when using AI models on this platform, as well as disclaimers regarding the service.

No liability

Neither the Creator of the AI model nor Coachvox AI accepts any liability for any loss or harm that may arise from interacting with the AI model, irrespective of the circumstances. This includes, but is not limited to, inaccurate or misleading information generated by the AI model.

No warranties

The AI models and all associated services are provided “as is,” without any kind of warranty, either express or implied. This means we do not guarantee the service will be uninterrupted, timely, secure, or free from errors

Data handling and privacy

Your data privacy is important to us. This section will clarify how your data is managed when you interact with our AI models.

Data collection and usage

When you engage with the AI models on this platform, we collect certain types of data including, but not limited to, the content of your chats, your name, and your email address. This information is accessible to the Automation Hub AI model you interact with as well as Coachvox AI administrators.

Data retention

We store your data indefinitely unless you request its deletion. To initiate the data deletion process, you will need to contact us directly.

Data sharing

Your data will not be shared with any third parties beyond Coachvox AI administrators and The digital Success Group. If the Creator has additional data sharing practices, those will be outlined in their own privacy policy and terms of business.

Use for sales and marketing

By interacting with AI models developed on this platform, you acknowledge that your data may be used for sales and marketing purposes.

Data deletion

Should you wish for your data to be “forgotten” or deleted, please contact us directly.
